West Los Angeles Superior Court Judge Joseph S. Biderman also refused to order the removal of a scene that includes the two men, who claim they had been duped into misbehaving on camera.
Biderman issued his two-page decision on Friday after hearing arguments the previous day.
The South Carolina fraternity brothers sued November 9, claiming they were tricked into making racist and sexist remarks to British comedian Sacha Baron Cohen in "Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan."
In one scene of the mockumentary, Cohen as rowdy Kazakh journalist Borat hangs out with three men in a motor home and watches the Pamela Anderson-Tommy Lee sex tape. One of the three men did not participate in the lawsuit.
The fraternity brothers claim the filmmakers got them drunk before getting them to sign release forms agreeing to appear in the film. Their names do not appear in the lawsuit.
The film "made plaintiffs the objects of ridicule, humiliation, mental anguish, and emotional and physical distress," the lawsuit claims.
A trial date for the lawsuit, which seeks unspecified monetary damages, has not been set.

On Sunday 17th December, the Charity Symphony Orchestra will be performing a new arrangement of Kid A for piano and orchestra in London
The concert also includes a premiere of a new Jazz Piano Concerto and Prokofiev's Peter and the Wolf. The concert starts at 7:30pm. Tickets are 8 GBP or 5 GBP with student ID and all proceeds are going to Diabetes UK. Refreshments are available and there will also be a chance to win two tickets to Mauritius.

That is right people, the performance, and the entire show "From The Basement" featuring performances by the White Stripes, Four Tet, and of course Thom Yorke was accidently put up for sale on iTunes yesterday! Hours later the people at iTunes realized they made a huge mistake and took it off as it is not suppose to come out until the 18th. Of course people downloaded it and you can find it online now! I of course have heard/seen the performance by Thom Yorke and it is incredible. Thom plays two new Radiohead tracks on the piano! If I were you I would check the tracks out they are incredible. Make sure you puchase the From The Basement show from iTunes when it comes out because we all need to support our boy Nigel Godrich. Also make sure you support us, if you know what I'm saying. Well as previously reported here the Grammy nominations came out today. As usual they are only about 35% on the money. Then again this is a pop event so you can't expect those who are not somewhat popular to get a nom. Now everyday for the next week or so I am going to post the nominations per category that I am familiar with. Each day I will also put (who should win, who probably will win, and who shouldn't be there if there is one) I will only use one of each. The first one we are going to cover is Record of the Year.

They, the voters, as usual, will nominate the worst people ever. The grammys, like every other American music awards is turning into a joke. But who know, maybe they will nominate some deserving artists. I will post the noms here after they are announced.
